Acceptance of Terms of Use

These Terms of Use govern your use of The Movie Booth service. By using The Movie Booth, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use The Movie Booth service. These Terms of Use are an ongoing contract between you and The Movie Booth and apply to your use of The Movie Booth service. These Terms of Use affect your rights and you should read them carefully

Standard Terms and Conditions

1. You agree to abide by The Movie Booth Terms and Conditions as set out below.

2. To rent any rental item you and/or the authorised renter(s) must use a valid credit/debit card. The Movie Booth reserves the right to refuse to rent any rental item to you and/or any authorised renter(s) without a valid payment format.

3. You will accept full liability for any and all charges and amounts due to The Movie Booth.

4. You authorise The Movie Booth to debit your current Credit/Debit Card account in order to recover all charges and amounts due and owing to The Movie Booth including but not limited to extra night option fees, rental item replacement costs, malicious damage, and reasonable legal costs incurred in connection with the recovery of all outstanding charges and amounts owing by you and/or any authorised renter(s).

5. If you and/or the authorised renter(s) fail to return any rental item(s) when due you will be charged extra night option fees. Extra night option fees (as displayed on the machine) will be charged for every day the rental item(s) is overdue subject to a maximum of 21 days.

6. If you and/or the authorised renter(s) fail to return any rental item(s) your Credit/Debit Card account will be debited an amount equal to:

6.1 The recommended price of the rental item; and

6.2 The extra night option fees subject to a maximum of 21 days.

7. You agree to return any rental item(s) in the same condition as when hired out. If malicious damage is caused to any rental item whilst rented to you and/or any authorised renter(s), The Movie Booth will debit from your current Credit/Debit Card account an amount equal to the Recommended Retail Price of the rental item(s).

8. If you do not have a Credit/Debit Card or your Credit/Debit Card has expired or you have exceeded your Credit/Debit Card limit The Movie Booth will instruct a credit agency in order to recover all charges and amounts due and owing to The Movie Booth, including but not limited to the charges and amounts set out in Clause 4 and you consent to the provision of personal details held by The Movie Booth relating to you to be passed to such credit agency.

9. For the purposes of these Terms and Conditions the Recommended Retail Price shall mean the retail price recommended for the sale of the rental item(s) as specified by the manufacturer and/or distributor, or in the absence of such recommendation The Movie Booth normal price of the rental item(s) applicable at the date the charge is debited.

10. You must notify The Movie Booth if you change your phone number or email address. All correspondence will be deemed to be served if directed to the details last notified to The Movie Booth.

11. If the machine is out of service it is the customer's responsibility to arrange for the movie to be returned at a time no later than 48 hours otherwise standard charge will apply.

12. You authorise The Movie Booth to perform a validation of your Credit/Debit card upon rental of DVD. No charge will be made until your DVD has been returned to the machine, upon which a charge will be made to the authorised account for the due amount set in The Movie Booth tariffs (seen on the machine).

13. As a Pay-as-you-go Member you are only able to rent two titles at a time.

Disclaimers of Warranties and Limitations on Liability

The Movie Booth service is provided "as is" and we make no representations or warranties of any kind with respect to The Movie Booth contents or our service. We assume no liability or responsibility for any errors or omissions in the content of The Movie Booth content, any failures, delays, or interruptions in the service. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our machine is accurate, complete or current.

In no event shall The Movie Booth, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of The Movie Booth service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

Copyright

All content included on The Movie Booth service and delivered to subscribers as part of the service, including DVDs, is the property of The Movie Booth and is protected by United Kingdom and international copyright laws. The Movie Booth reserves the right to terminate all accessibility hereunder if The Movie Booth, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the copying of DVDs rented to you by us or the copying or other unauthorized use of our proprietary content. The Movie Booth does not promote, foster or condone the copying of DVDs or any other infringing activity. The use of DVDs rented to you by us is solely for your personal and non-commercial use.

Trademarks

The Movie Booth is a registered trademark. The Movie Booth logo or services are marks of The Movie Booth. The Movie Booth Web site, including but not limited to its graphics, logos, page headers, button icons, scripts and service names constitute trade dress of The Movie Booth. The trademarks, service marks and trade dress of The Movie Booth may not be used or reproduced without prior written approval from The Movie Booth and may not be used in connection with any product or service that is not affiliated with The Movie Booth in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of The Movie Booth or in any manner that disparages or discredits The Movie Booth. Other trademarks that appear on The Movie Booth Web site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by The Movie Booth. Any images of persons or personalities contained on The Movie Booth Web site are not an indication or endorsement of The Movie Booth or any particular product or our service unless otherwise indicated.

Electronic Communications

By using The Movie Booth service, you consent to receiving electronic communications or text messages from The Movie Booth. These communications will include notices about your account and information concerning or related to our service, such as featured films or other entertainment information or offerings. These communications are part of your relationship with The Movie Booth and you receive them as part of The Movie Booth subscription. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Limitations on Use

You must be 18 years of age or older to subscribe to The Movie Booth service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. While The Movie Booth does distribute products that may be watched by children, we do not intentionally seek to collect information from underage individuals. Unless otherwise specified, the content on The Movie Booth machine is for your personal and non-commercial use and we grant you a limited license to access for that purpose. The Movie Booth does not promote, foster or condone the copying of DVDs or any other infringing activity.

Sale of Previously-Viewed Titles

We offer select previously-viewed titles for sale on our machine. The titles available for sale may change from time to time and are subject to continued availability. Your DVD purchase will be charged to your chosen credit/debit card. All movies are sold “as is”. There are no refunds on titles purchased on the machine.

Right to Terminate

We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.

Changes to Terms of Use

The Movie Booth reserves the right, from time to time, with or without notice to you, to change these Terms of Use at our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms" located at www.themoviebooth.com or at the machine. The most current version of the Terms of Use will supersede all previous versions. Your continued use of The Movie Booth service after changes are made means that you agree to be bound by such changes.
